Terms of service
§ 1 Scope and provider
(1) These terms of service ("Terms") govern the use of the online service PianoLix (the "Service"), available at pianolix.com.
(2) The provider is PianoLix, Philipp Bernardy, Schmiedgasse 3, 86150 Augsburg, Germany ("we"). Contact: hello@pianolix.com. Full details in the legal notice.
(3) Only these Terms apply. We object to any conflicting terms.
§ 2 Description of the service
(1) PianoLix converts audio (recording or upload) into notes and creates piano tutorials with falling notes that can be played back and downloaded as a video.
(2) The specific feature set depends on the chosen plan (see § 4). We continuously develop the Service and may change, add or discontinue features as long as the essential purpose of the contract is preserved.
(3) The Service is provided with customary availability. Maintenance windows, force majeure or disruptions at upstream suppliers may lead to temporary limitations.
§ 3 Registration and account
(1) An account is required to use the Service. Your information must be accurate; keep your credentials confidential.
(2) The offering is aimed at persons aged 16 and over, or - for minors - with the consent of a parent or guardian.
§ 4 Plans, prices and payment
(1) PianoLix is offered in the following plans:
- Free - €0: basic features with limitations (e.g. watermark on the video, limited library, no audio-to-notes transcription).
- Pro - €12.99 / month (incl. VAT): audio-to-notes transcription, HD download without watermark, unlimited library.
- Studio - €24.99 / month (incl. VAT): all Pro features plus extended studio features.
The features and prices shown at checkout at the time of your order are authoritative.
(2) Paid plans are concluded as a monthly subscription and billed via our payment provider Stripe. Payment is due in advance for the respective billing period.
(3) The subscription renews automatically for another billing period unless cancelled (see § 6). We announce price changes in advance; they apply from the next billing period.
§ 5 Conclusion of contract
The contract for a paid plan is concluded when you complete the ordering process (clicking the payment button at checkout) and your payment is confirmed. You will receive a confirmation by email.
§ 6 Term and cancellation
(1) The subscription runs for an indefinite period and can be cancelled at any time to the end of the current billing period.
(2) You can cancel conveniently via the customer portal ("Manage billing" in Settings) or informally by email to hello@pianolix.com.
(3) Once the cancellation takes effect, the account is downgraded to the Free plan. You can have the Free account deleted at any time.
§ 7 Right of withdrawal
Withdrawal notice for consumers
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the conclusion of the contract. To exercise your right of withdrawal, a clear statement is sufficient (e.g. an email to hello@pianolix.com). To meet the deadline, it is sufficient to send your notice before the period expires.
Consequences: in the event of an effective withdrawal, we will refund any payments already made without undue delay.
Early expiry: For digital content/services, the right of withdrawal expires once we have begun performance after you have expressly agreed that we may begin before the withdrawal period expires and you have confirmed that you thereby lose your right of withdrawal (§ 356 (4)/(5) BGB).
§ 8 User obligations and rights in content
(1) You may only process audio and create tutorials for which you hold the necessary rights. You are responsible for uploading copyrighted works without permission.
(2) You may use the tutorials/videos created with PianoLix within the scope of the rights you hold in the underlying works. Publishing on third-party platforms is subject to their terms.
(3) Abusive use (e.g. circumventing technical limitations, automated bulk scraping, illegal content) is prohibited.
§ 9 Liability
We are liable without limitation for intent and gross negligence, under the German Product Liability Act, and for injury to life, body or health. For slight negligence we are liable only for breach of material contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract. Otherwise liability is excluded.
§ 10 Changes to these Terms
We may change these Terms with effect for the future where this is necessary for good cause (e.g. legal changes, new features) and does not unreasonably disadvantage you. We will inform you of changes in good time; if you do not object, they are deemed accepted - we will point this out separately.
§ 11 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of your country of residence remain unaffected. Should any provision be invalid, the remainder of the contract stays valid. For online dispute resolution, see the legal notice.
